Seller & Commerce Terms

Plain summary

If you sell on Cyca, you're the merchant — not us. You're responsible for your listings being accurate, for delivering what you sold, and for complying with the law and tax rules where you operate.

Cash on delivery means you collect payment yourself; Cyca does not process or hold that money. Buyers' delivery details are given to you only to fulfil the order. Ratings unlock only after delivery.

Scope and relationship

In plain English: These terms apply to anyone who sells, and to buyers for the parts about orders and ratings.

These Seller & Commerce Terms apply to every person who opens a shop, lists an item, runs a live session for commercial purposes, or places an order through Live Market. They form part of the Terms of Service.

You are an independent seller. OCARRY LLC is not the seller, merchant of record, employer, agent, or partner in your sales. The contract of sale is between you and the buyer. We provide the platform, the live streaming, the order flow, and the support community.

Seller eligibility

In plain English: Be legally able to sell what you're selling, where you're selling it.

To sell you must be at least 18 years old, or the age of majority where you live if higher, and legally able to enter into contracts. You must hold any licence, permit, or registration that the law of your jurisdiction requires for the goods you sell, and you must be able to issue whatever receipt or invoice your local law requires.

Listings and accuracy

In plain English: Describe things honestly. Show the real item. Don't hide conditions.
  • Descriptions, photographs, and any claims made in a live session must accurately represent the item actually being sold, including its condition, quantity, and any defects.
  • The price displayed in the app must be the price you will charge, in the local currency of your market. Any additional charge — delivery, for example — must be disclosed before the buyer confirms.
  • Do not use another person's photographs, brand assets, or copy without the right to do so.
  • If you cannot fulfil a listing, remove it.

Prohibited items

In plain English: No weapons, drugs, counterfeits, live animals, human remains, stolen goods, or anything illegal locally.

The following may not be listed or sold through Cyca:

  • weapons, ammunition, explosives, and their components;
  • illegal drugs, controlled substances, and drug paraphernalia;
  • prescription medicines and unapproved medical devices or treatments;
  • counterfeit goods and unauthorised replicas;
  • stolen goods, or goods you do not have the right to sell;
  • live animals, endangered species, and products made from them;
  • human remains or bodily fluids;
  • tobacco, vaping products, and alcohol, where their remote sale is restricted;
  • adult or sexual content and services;
  • financial instruments, currency, and gift-card arbitrage;
  • any item whose sale is unlawful where you or your buyer is located.

We may remove listings and terminate shops for violations, without refund of any amount and without notice where the violation is serious.

Going live

In plain English: A live session is a public broadcast, subject to the Community Guidelines.

Live sessions are governed by the Community Guidelines. You are responsible for the content of your stream, including comments posted by viewers while you are broadcasting. A live session may be shared by link and viewed in a web browser by people who do not have the app.

When you open Live Market, the app uses your approximate location while Live Market is in use so that nearby buyers can find you and so that you can see nearby sellers. It is used for proximity only, and stops when you leave Live Market. You control this permission in your device settings; declining it limits location-based discovery.

Orders, payment, and cash on delivery

In plain English: You collect the money. Cyca doesn't process, hold, or guarantee payment.

When a buyer confirms an order, Cyca records the order and passes to you the details required to fulfil it: the buyer's name, phone number, delivery address and its coordinates, the items and quantity, the price shown at the time of order, and the selected payment type.

Currency. Prices are listed and charged in the local currency of the market you sell in — Cyca does not impose a single fixed currency. You are responsible for listing prices in the correct local currency, for any conversion you choose to offer, and for meeting the price-display requirements of the law that applies to your sale.

Cyca does not process payments. Where an order is placed as cash on delivery, or the buyer elects to pay the seller directly, payment passes between buyer and seller without OCARRY LLC taking custody of funds. We do not hold, escrow, guarantee, refund, or insure that money, and we are not a payment processor, money transmitter, or payment intermediary for such orders.

You are responsible for collecting the correct amount, for handling cash safely, and for providing any receipt required by law.

Delivery

In plain English: Deliver what was ordered, in the time you promised, to the address given.

You must fulfil accepted orders within the timeframe you communicated, deliver to the address supplied with the order, and keep the buyer informed of the order status through the order thread. If you cannot fulfil an order, cancel it promptly and tell the buyer why.

Risk of loss and title pass according to the law applicable to your sale; unless local law provides otherwise, you bear responsibility for the goods until delivery is completed.

Buyer data — how you must handle it

In plain English: Delivery details are for fulfilling the order only. Not for marketing. Not for resale.

The buyer information you receive is provided for the sole purpose of fulfilling and supporting that order. You must:

  • use it only to fulfil, deliver, and support the order, and to meet legal or tax obligations;
  • not use it for marketing, add it to a mailing list, sell it, or share it with third parties beyond your delivery provider;
  • keep it secure and retain it no longer than your legal obligations require;
  • delete it on request where no legal obligation requires retention;
  • comply with the data-protection law applicable to you — you act as an independent controller of the buyer data you receive.

Cancellations, refunds, and disputes

In plain English: Publish your policy and honour it. Disputes are between you and the buyer; we may act on patterns.

You must set and honour a cancellation and refund policy consistent with the consumer-protection law that applies to your sale. Buyers have whatever statutory rights their local law provides, and these terms do not reduce them.

Disputes about an order are resolved between buyer and seller, in the first instance through the order thread in the shop's support community, which escalates to Urgent automatically if a seller does not respond. OCARRY LLC is not a party to the sale and does not adjudicate individual disputes, but we may suspend or terminate shops where the pattern of complaints indicates fraud or repeated failure to deliver.

Ratings

In plain English: Ratings unlock only after delivery, so they reflect real transactions.

A buyer may rate an order only after it has been marked delivered. Sellers must not offer inducements for positive ratings, threaten buyers over ratings, or attempt to manipulate ratings through fabricated orders. We may remove ratings obtained in violation of this section and act against the account responsible.

Taxes

In plain English: Your sales, your taxes.

You are solely responsible for determining, collecting, reporting, and remitting any tax arising from your sales, including any sales, use, VAT, GST, or income tax. OCARRY LLC does not calculate, collect, or remit tax on your behalf and provides no tax advice.

Suspension of a shop

In plain English: We can suspend shops for violations, fraud, or repeated failure to deliver.

We may suspend or terminate a shop, remove listings, or end a live session where we reasonably believe these terms, the Terms of Service, or the Community Guidelines have been violated, or where required by law. You remain responsible for fulfilling orders accepted before suspension.

Indemnity

In plain English: If your sales cause us a legal claim, you cover it.

To the extent permitted by law, you agree to indemnify and hold harmless OCARRY LLC from claims, damages, and reasonable legal costs arising out of the goods you sell, your listings and streams, your handling of buyer data, or your breach of these terms.
