Terms of Service

Plain summary

These are the rules for using Cyca. You must be at least 13. Register with a phone number you control. Don't use Cyca to break the law or harm people.

What you send stays yours — we only take the limited licence needed to deliver it. Cyca is provided “as is,” and if you sell or buy on Live Market, the Seller & Commerce Terms also apply.

Agreement

In plain English: Using Cyca means you accept these Terms and the Privacy Policy.

These Terms of Service (“Terms”) form an agreement between you and OCARRY LLC (Webster, Texas, USA). By creating an account or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use Cyca.

Additional terms apply to specific features: the Seller & Commerce Terms govern buying and selling, and the Community Guidelines govern conduct. Where they conflict with these Terms on their subject matter, those documents control.

Eligibility

In plain English: 13 and over — or older, if your country requires it.

You must be at least 13 years old to use Cyca. If the law where you live sets a higher minimum age for services of this kind, that higher age applies. By using Cyca you represent that you meet this requirement.

Your account

In plain English: Your phone number is your identity. Keep control of it — whoever receives your codes can access your account.

Register with a phone number you actually control, and keep control of it: anyone who can receive your verification codes can access your account. You are responsible for activity that occurs through your account. One account per phone number.

If you lose control of your number, contact us promptly. We may reclaim numbers that have been recycled by a carrier and reassigned to a different person.

Acceptable use

In plain English: Don't break the law, harass people, spam, impersonate, scrape, or attack the service. Zero tolerance for child sexual abuse material.

Do not use Cyca to break the law or to harm people. Prohibited activity includes:

  • harassment, threats, stalking, or intimidation;
  • content that is illegal where you or your recipients live;
  • child sexual abuse material in any form — zero tolerance; such content is removed and reported to the relevant authorities, and the account is terminated;
  • spam, bulk unsolicited messaging, or automated scraping;
  • impersonating another person or misrepresenting your affiliation;
  • distributing malware or malicious links;
  • infringing another person's intellectual property;
  • attempting to breach, overload, reverse-engineer, or disrupt the Services or other users' accounts.

Sync only address books you genuinely control, and respect the privacy of the people in them. The Community Guidelines describe conduct expectations in more detail, including rules specific to live streams.

Your content

In plain English: Your content stays yours. We take only the licence needed to store and deliver it. We never use it for advertising.

What you send remains yours. You grant us only the limited, non-exclusive licence necessary to operate the Services: to store your messages, media, and statuses, and to transmit them to the people you address them to, and — for content you publish into a live stream or a community — to display it to the audience you have chosen.

We do not publish your private content and we do not use your content for advertising. You are responsible for the content you send. Statuses expire after 24 hours; messages persist as described in the Privacy Policy.

Live streams and communities

In plain English: Anything you say in a live stream or community channel is public to that audience — including people watching on the web without the app.

Live Market sessions may be shared by a seller as a link that anyone can open in a web browser without installing Cyca or creating an account. Comments, reactions, and your display name and profile photo shown during a session are visible to everyone watching, including such web viewers.

Buying from a shop enrols you in that shop's support community, where the seller can post announcements and where a thread relating to your order exists. You may leave a community at any time; leaving does not cancel an order.

Buying and selling

In plain English: Orders are agreements between the buyer and the seller. We operate the platform; we are not the merchant.

Cyca provides the platform on which buyers and sellers transact. Unless we state otherwise in writing, OCARRY LLC is not the seller, merchant of record, or party to the sale. The contract of sale is between the buyer and the seller.

Detailed obligations — listing accuracy, pricing, cash on delivery, delivery, cancellations, refunds, disputes, and ratings — are set out in the Seller & Commerce Terms, which form part of these Terms for anyone who buys or sells on Cyca.

The Services

In plain English: Provided “as is.” We build for weak networks but can't promise perfection.

The Services are provided “as is” and “as available,” without warranties of any kind, to the fullest extent the law allows. We build Cyca to hold up on weak networks, but we cannot promise uninterrupted service, delivery of every message, or that every call or live stream will connect.

We may change, suspend, or discontinue features, and may impose reasonable limits to keep the Services healthy and available to everyone.

Suspension and termination

In plain English: You can leave any time. We may suspend accounts that break the rules.

You may stop using Cyca and delete your account at any time via Settings → Account; see Account Deletion. We may suspend or terminate accounts that violate these Terms, harm other users, or create legal risk. Where practical we will tell you why and, where appropriate, give you an opportunity to respond.

Provisions that by their nature should survive termination — including licence grants necessary for delivered content, liability limits, and governing law — survive.

Liability

In plain English: Our liability is limited to the extent the law allows. Nothing here removes rights you can't legally waive.

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Services. Our total aggregate liability for any claim is limited to the amount you paid us for use of Cyca in the preceding 12 months — which, for a free application, is zero — except where the law does not permit such a limit.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud.

Changes to these Terms

In plain English: We'll tell you in the app before material changes take effect.

We may update these Terms; the effective date above always reflects the current version. For material changes we will notify you within the app, and continuing to use Cyca after a change takes effect means you accept the updated Terms.

Governing law

In plain English: Texas law, Texas courts — unless your home country gives you rights you can't waive.

These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law rules. Disputes belong to the state or federal courts located in Texas — except where the law of your country of residence grants you rights or a forum that cannot be waived, in which case those rights are unaffected.
